All shipments will be made through the USPS. Standard shipping is 4-6 business days for delivery. Expedited shipping is 2-4 days for delivery. We do not offer “Next-day Shipping”. All orders ship to USA addresses only.

Warranties, Returns, Replacements and Refunds

Warranty

Hyperion offers a 2 Year No Hassle (limited) manufacturer warranty on all of our batteries. All other products are covered by a 2 Year No Hassle Warranty unless otherwise stated in the product description or documentation included with the product. This warranty applies only to the original purchaser and is non-transferable. In order to be covered by this warranty you must have a valid order number in our system. This warranty does not cover abuse, improper charging or handling such as drops and exposure to extreme heat or cold. Items that are sold as Pre-Owned (used), have no warranty expressed or implied. NOTE: Hyperion EA holds no liability for damage to devices, loss of data or loss of business or profits from products sold directly or indirectly by our company. Replacement products unless specifically stated in writing do not extend the warranty period.

Reasons for Returns, Replacements and Refunds:

If you are not satisfied with your purchase, you may return any unused and unopened item for a refund* (not including shipping costs) within the first 30 days following your order. Please keep all original packaging; items not in their original condition are not returnable. If the item arrives damaged or defective, we will gladly ship you a replacement at no extra charge. If you receive an incorrect item, please give us the phone’s model number (located under the battery on most phones) so we can verify the correct item and ship you a replacement at no extra charge along with a prepaid return label to ship the incorrect item back to us. If you do not receive your item, it is likely due to a shipping error or an incomplete address. Please provide us with a confirmation of the shipping address and we will resend the item at no extra charge.

How to Initiate the Return, Replacement or Refund Process:

Please include the following with your return:

1. Your Order ID Number.

2. Your Name or User ID

3. The reason for the return. For example: Is the item defective or damaged? Was the wrong item shipped?

  We will reply by email with a return authorization number and shipping instructions for your return. We accept returns at our branch office locations listed on our website. We suggest shipping with a carrier that provides proof of delivery as items lost or damaged in transit cannot be credited. UPS and FedEx automatically provide this. Affix the label to the outer box or packaging with the return authorization number and return shipping address.

  No returns of any kind can be accepted without a return authorization number. Once our warehouse has processed your return, the refund will be applied to your payment method. Please allow up to 5 business days for the processing of returned merchandise. Refunds are processed every week on Wednesdays and Fridays. Hyperion EA pays return shipping only for items shipped to you in error or received damaged or defective. Any claims for damage and/or shortages should be made within 14 days of the date of shipment.

Battery Use and Safety

Important! Handle and store batteries properly to avoid injury or damage. Most battery issues arise from improper handling of batteries and, particularly, from the continued use of damaged batteries.

  •  Do not disassemble, crush, puncture, shred or otherwise attempt to change the form of your battery. Do not put a high degree of pressure on the battery. This can cause leakage or an internal short-circuit, resulting in overheating.
  • Do not let the phone or battery come in contact with liquids. Liquids can get into the phone’s circuits, leading to corrosion. Even when the phone appears to be dry and appears to operate normally, the circuitry could slowly corrode and pose a safety hazard. If the phone and/or battery get wet, have them checked by your service provider or contact Hyperion, even if they appear to be working properly.
  • Do not place your battery in or near a heat source. Excessive heating can damage the phone or the battery and could cause the phone or the battery to explode. Do not dry a wet or damp battery with an appliance or heat source such as a microwave oven, hair dryer, iron, or radiator. Avoid leaving your phone in your car in high temperatures.
  • Do not dispose of the phone or place the battery in a fire. The phone or the battery may explode when overheated.
  • Do not handle a damaged or leaking battery. Do not let leaking battery fluid come in contact with your eyes, skin or clothing. For safe disposal options, contact your nearest Hyperion-authorized service center.
  • Avoid dropping the cell phone. Dropping the phone or the battery, especially on a hard surface, can potentially cause damage to the phone and battery. If you suspect damage to the phone or battery, take it to a service center for inspection.
  • Never use any charger or battery that is damaged in any way.
  • Do not allow the battery to touch metal objects. Accidental short-circuiting can occur when a metallic object (coin, key, jewelry, clip or pen) causes a direct connection between the + and – terminals of the battery (metal strips on the battery), for example when you carry a spare battery in a pocket or bag. Short-circuiting the terminals may damage the battery or the object causing the short-circuiting.
  • Always charge and use the phone in well ventilated areas.  Smart phones are essentially mini-computers with microprocessor that heats up when it is running (GPS, internet, 3G and 4G, streaming video and audio).  Continued use when not properly vented can cause damage to the battery and swelling.  If battery over heats (very hot to the touch) or battery swells, cease using immediately and contact our customer service for replacement.
  • Do not use if battery overheats or swells.  If a battery becomes too hot to touch or swells, it is a indication that the battery is malfunctioning and should not be used.
  • Do not charge while running certain apps. GPS, streaming music or audio, and other live-run apps can “fool” the Battery Management System (BMS) and cause overheating or over charging of the battery.

 

Cell Phone Cases

  • Do not drop your phone.  While TPU and Silicone cases are tough and well constructed, they are not meant to protect delicate cell phones from drops and falls.
  • Do not sit with your phone in your pocket.  Cell phones are rigid but breakable.  The face plate is made of tempered glass and can be broken if too much pressure is placed on the surface.
  • Carefully install your Hyperion case.  Our cases are designed to fit your phone exactly.  If it is too tight or too loose, we recommend you contact our customer service for assistance.  Always start at the bottom and carefully press the lip of the case around the edge of the phone.

 

Phone or Property Damage

What if my phone or property has been damaged? Hyperion’s 2 Year No Hassle Warranty covers the Hyperion product only against manufacturer defects.  Each of our batteries are design to work with your phone and have a built in Integrated Circuit Chip that communicates with the phone to ensure correct charging, maintain functions and “handshake” with the Battery Management System (BMS).  There are a multitude of reasons why a battery may malfunction including:

Installation of certain apps.

Poor ventilation.

Exposure to heat or cold.

OS software updates.

Damage from being dropped.

Running GPS, 3G/4G, streaming audio or video while charging.

Because of these and other reasons, it may be impossible to tell what causes a battery to malfunction.  If an incident has occurred, please contact our customer service department for assistance. Think of when you buy a car.  A new car will come with a manufacturer warranty so that if anything in the car breaks down, the manufacturer will warranty the replacement or repair.  On top of the manufacturer warranty, a car owner is required to have auto insurance that covers the owner in the case of accident.  The manufacturer warranty does not cover accidental repairs.  Similarly, cell phone providers offer insurance on cell phones for the same reasons.  Hyperion recommends that all cell phone users enroll in accident prevention programs offered by their local carriers.  Hyperion covers manufacturer defects only and does not cover any accidental or incidental damages.

Warranty Information

 Standard Limited Warranty  What is covered and for how long? HYPERION warrants that HYPERION’s batteries and accessories (“Products”) are free from defects in material and workmanship under normal use and service for the period commencing upon the date of purchase by the first consumer purchaser and continuing for the following specified period of time after that date: Batteries                  2 Year Other Phone Accessories        2 Year What is not covered? This Limited Warranty is conditioned upon proper use of the Product. This Limited Warranty does not cover: (a) defects or damage resulting from accident, misuse, abnormal use, abnormal conditions, improper storage, exposure to liquid, moisture, dampness, sand or dirt, neglect, or unusual physical, electrical or electromechanical stress; (b) scratches, dents and cosmetic damage, unless caused by HYPERION; (c) ordinary wear and tear; (d) defects or damage resulting from improper testing, operation, maintenance, installation, service, or adjustment; (e) defects or damage resulting from external causes such as collision with an object, fire, flooding, dirt, windstorm, lightning, earthquake, exposure to weather conditions, theft, blown fuse, or improper use of any electrical source; This Limited Warranty covers batteries only if battery capacity falls below 80% of rated capacity or the battery leaks, and this Limited Warranty does not cover any battery if (i) the battery has been charged by a battery charger not specified or approved by HYPERION for charging the battery; (ii) any of the seals on the battery are broken or show evidence of tampering; or (iii) the battery has been used in equipment other than the phone for which it is specified. What are HYPERION’s obligations? During the applicable warranty period, provided the Product is returned in accordance with the terms of this Limited Warranty, HYPERION will repair or replace the Product, at HYPERION’s sole option, without charge. HYPERION may, at HYPERION’s sole option, use rebuilt, reconditioned or new parts or components when repairing any Product, or may replace the Product with a rebuilt, reconditioned or new Product. Repaired/replaced cases, pouches and holsters will be warranted for a period of 2 years. All other repaired/replaced Products will be warranted for a period equal to the remainder of the original Limited Warranty on the original Product or for 2 years, whichever is longer. All replaced Products, parts, components, boards and equipment shall become the property of HYPERION. Except to any extent expressly allowed by applicable law, transfer or assignment of this Limited Warranty is prohibited.   What must you to do obtain warranty service? To obtain service under this Limited Warranty, you must return the Product to HYPERION in an adequate container for shipping, accompanied by the sales receipt or comparable proof of sale showing the original date of purchase, the serial number of the Product. To obtain assistance on where to deliver the Product, please call HYPERION Customer Care at 1-616-530-3843. If HYPERION determines that any product is not covered by this Limited Warranty, you must pay all parts, shipping, and labor charges for the repair or return of such Product.   What are the limits on HYPERION’s liability? THIS LIMITED WARRANTY SETS OUT THE FULL EXTENT OF HYPERION’S RESPONSIBILITIES, AND THE EXCLUSIVE REMEDY REGARDING THE PRODUCTS. ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY, IN NO EVENT SHALL HYPERION BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT OR FOR, WITHOUT LIMITATION, COMMERCIAL LOSS OF ANY SORT; LOSS OF USE, TIME, DATA, REPUTATION, OPPORTUNITY, GOODWILL, PROFITS OR SAVINGS; INCONVENIENCE; INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; OR DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT. SOME STATES AND JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE DISCLAIMER OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND DISCLAIMERS MAY NOT APPLY TO YOU. HYPERION MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, AS TO THE QUALITY, CAPABILITIES, OPERATIONS, PERFORMANCE OR SUITABILITY OF ANY THIRD-PARTY SOFTWARE OR EQUIPMENT USED IN CONJUNCTION WITH THE PRODUCT, OR THE ABILITY TO INTEGRATE ANY SUCH SOFTWARE OR EQUIPMENT WITH THE PRODUCT, WHETHER SUCH THIRD-PARTY SOFTWARE OR EQUIPMENT IS INCLUDED WITH THE PRODUCT DISTRIBUTED BY HYPERION OR OTHERWISE. RESPONSIBILITY FOR THE QUALITY, CAPABILITIES, OPERATIONS, PERFORMANCE AND SUITABILITY OF ANY SUCH THIRD-PARTY SOFTWARE OR EQUIPMENT RESTS SOLELY WITH THE USER AND THE DIRECT VENDOR, OWNER OR SUPPLIER OF SUCH THIRD-PARTY SOFTWARE OR EQUIPMENT. Nothing in the Product instructions or information shall be construed to create an express warranty of any kind with respect to the Products. No agent, employee, dealer, representative or reseller is authorized to modify or extend this Limited Warranty or to make binding representations or claims, whether in advertising, presentations or otherwise, on behalf of HYPERION regarding the Products or this Limited Warranty. This Limited Warranty gives you specific legal rights, and you may also have other rights that vary from state to state. What is the procedure for resolving disputes? ALL DISPUTES WITH HYPERION ARISING IN ANY WAY FROM THIS LIMITED WARRANTY OR THE SALE, CONDITION OR PERFORMANCE OF THE PRODUCTS SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, AND NOT BY A COURT OR JURY. Any such dispute shall not be combined or consolidated with a dispute involving any other person’s or entity’s Product or claim, and specifically, without limitation of the foregoing, shall not under any circumstances proceed as part of a class action. The arbitration shall be conducted before a single arbitrator whose award may not exceed, in form or amount, the relief allowed by the applicable law. The arbitration shall be conducted according to the American Arbitration Association (AAA) Commercial Arbitration Rules applicable to consumer disputes. This arbitration provision is entered pursuant to the Federal Arbitration Act. The laws of the State of Michigan, without preference to its choice of laws principles, shall govern the interpretation of the Limited Warranty and all disputes that are subject to this arbitration provision. The arbitrator shall decide all issues of interpretation and application of this arbitration provision and the Limited Warranty. For any arbitration in which your total damage claims, exclusive of attorney fees and expert witness fees, are $5,000.00 or less (“Small Claim”), the arbitrator may, if you prevail, award your reasonable attorney fees, expert witness fees and costs as part of any award, but may not grant HYPERION its attorney fees, expert witness fees or costs unless it is determined that the claim was brought in bad faith. In a Small Claim case, you shall be required to pay no more than half of the total administrative, facility and arbitrator fees, or $50.00 of such fees, whichever is less, and HYPERION shall pay the remainder of such fees.  Administrative, facility and arbitrator fees for arbitration in which your total damage claims, exclusive of attorney fees and expert witness fees, exceed $5,000.00 (“Large Claim”) shall be determined according to AAA rules. In a Large Claim case, the arbitrator may grant to the prevailing party, or apportion among the parties, reasonable attorney fees, expert witness fees and costs. Judgment may be entered on the arbitrator’s award in any court of competent jurisdiction. This arbitration provision also applies to claims against HYPERION’s employees, representatives and affiliates if any such claim arises from the Product’s sale, condition or performance. By accepting the Products, you agree to submit to the jurisdiction of the State of Michigan and agree that all such arbitration or actions or suits brought outside of arbitration relating to the subject matter hereof shall be brought exclusively in the state or federal courts located in Kent County, Michigan. You waive your right to object that the venue or forum set forth herein as improper or inconvenient.   Severability. If any portion of this Limited Warranty is held to be illegal or unenforceable, such partial illegality or unenforceability shall not affect the enforceability of the remainder of the Limited Warranty.
